Last Will and Testament
of
James Simmons
In the name of God, Amen.

I,
James Simmons of the County of Montgomery and State of North Carolina, being
weak in body, yet of sound and perfect mind and memory, blessed be God, do
publish and declare this my Last Will and Testament in manner and form as follows,
viz:

First of all, I resign my body to the dust from whence it was taken, and commit my soul
to God who gave it, with a full hope of being raised at the last day to reunite with the
soul at the resurrection of the just.  As to my worldly estate, my will and desire is that it
be disposed of as follows:

Whereas, I hold a debt against my son, Adam Simmons to the amount of Two
hundred and twenty five dollars, my will and desire is that my said son, Adam
Simmons, retain to himself as a share of my estate, thirty-four dollars.  The balance of
which said debt when collected I wish divided amongst the balance of children as
follows, viz: Sixty-eight dollars to my son, William Simmons; Thirty-four dollars to my
daughter Elizabeth Allen; Thirty-four dollars to the heirs of the body of my daughter,
Nancy Harrel; and the remaining Thirty-four dollars to my youngest son, Pleasant
Simmons, to be paid to each of them as soon as it may be collected.

It is further my will and desire that Elizabeth Allen have my desk.

And it is further my will and pleasing that my youngest son, Pleasant Simmons, have
my clock and still.

It is further my will and desire that whereas I have made a deed of gift for six head of
sheep to Mirandy Campbell.  The remaining of my stock of sheep I wish given to my
grand-daughter, Sarah Simmons.  

My will and desire is that my daughter-in-law, Christian Simmons, have my large wash
pot.

I give and bequeath to my grand-daughter, Mirandy Campbell, one heifer about three
years old.

As to the residue of my estate, goods and chattels, of what notion and kind soever,
my will and desire is that the whole be given to my said grand-daughter, Mirandy
Campbell, immediately after my decease.

Last of all, I appoint my son, Pleasant Simmons, executor of this my Last Will and
Testament, hereby revoking all former wills by me made.

In witness whereof, I the said James Simmons, have hereunto set my hand and affixed
my seal this 10th day of April  AD 1841.
