| Last Will and Testament of Benjamin Hubbard |

| In the name of God, Amen. I Benjamin Hubbard of the County of Halifax being sick weak but of perfect mind and memory do make this my Last Will and Testament in manner and form as following, to-wit: I give and bequeath to my loving son, Joel Hubbard, and to his heirs and assigns forever all the four hundred acres of land whereon I now live, except what lies above the edge of the old mill pond and a _____ line; also, my copper kettle. I give to my loving daughter, Judith Hubbard, and to her heirs and assigns forever all that piece or parcel of land that lies above the edge of the old mill pond and from thence following the branch up to the line between me and Benjamin Dickson and thence along the line to the river and thence down to the mill. I also leave her one bed and furniture. I give to my loving daughter, Sary (Sarah Hubbard), the lower part of my back survey to her and her heirs forever already divided by a line. I give to my daughter, Drusylla Hubbard, the upper half of the said survey and also a bed and furniture to her and her heirs forever. And to my son, Benjamin Hubbard, I give part of the land that I first bought of Benjamin Dickson to him and his heirs forever beginning at the new road where it crosses the yellow bank creek and from thence down new road to my line and from thence along my line to Fountain’s line and thence along Fountain’s line to his corner and from thence along my line to a corner hickory and thence along my line to the great road and thence down the yellow bank creek to the said road. I give to my wife, Hannah, a privilege without any interruption on the said place during the time of her widowhood where she will and I also give her one bed and furniture. And also to my son, Benjamin, I give bed and furniture. And to my loving daughter, Hannah, I give the land that I last purchased of Benjamin Dickson, excepting what lies over the yellow bank creek to her and her heirs forever. And to my daughter, Rebecca, I give the remainder part of the land that I last bought of Benjamin Dickson, to her and her heirs forever. And to my son, Nathaniel, I give the land lying on the Bannister River that I bought of Elijamary Bailey to him and his heirs forever. I lend to my wife, Hannah, my negro Sam during the space of ten years except she marries and at the end of ten years my will is that he shall be sold if he chooses it and if chooses not to be sold, I give him to my son, Benjamin. And I also lend to my wife, Hannah, my horse Prince and ten head of cattle which she may choose and one sow and shoats during the time of her widowhood and no more and all my household goods, except my working tools and then I leave to the use of my family. The rest to be equally divided amongst my six children and my land lying on Childrey Creek and my wagon I leave to be sold and my money due to me to be collected and what I have by me all to be divided equally amongst my seven youngest children, only my son, Nathaniel, to have twenty pounds more than the rest of them and my copper kettle which I have purchased I lend to my wife, Hannah, during the time of her widowhood and if any of my children should die without heirs, let their portion to sold and equally divided amongst the rest. It is also my desire and I do accordingly constitute and appoint Moses Hendrick and Joel Hubbard to be the executors of this my Last Will and Testament revoking all others heretofore by me made in witness whereof I have hereunto set my hand and assigned my seal this 13th day of October, 1770. Sealed and Delivered in the presence of Benjamin Hubbard (by his mark) James Bailey Sr. James Bailey Jr. At a Court held for Halifax County, the 21st day of March, 1771, this Will was exhibited into Court by the executors herein named who made oath hereto according to law and the same being proved by the oaths of two of witnesses thereto was ordered to be recorded and on the motion of the said executors. Certificate was granted them for obtaining a probate of the said Will in due form, they having first, with Benjamin Dickson and William Echols _____ their securities first entered into and acknowledged bond according to law.
